Acceptance of terms
These Terms of Service ("Terms") govern your access to and use of the CargoLinked platform at cargolinked.com and related services (the "Platform"), operated by CargoLinked.
By creating an account or using the Platform, you agree to these Terms. If you do not agree, do not use the Platform.
Eligibility
You must be at least 18 years old and authorized to bind your company (if registering on its behalf) to use the Platform.
Forwarders must provide accurate company information and maintain any licenses or authorizations required to operate as a freight forwarder in their jurisdiction.
Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.
You must provide accurate, current, and complete registration information and keep it updated.
We may suspend or terminate accounts that violate these Terms or pose a security or fraud risk.
Platform role
CargoLinked is a marketplace and directory platform. We are not a freight forwarder, carrier, customs broker, insurer, or party to any contract between shippers and forwarders.
Any agreement for freight services is solely between the shipper and the forwarder. CargoLinked is not responsible for the quality, timing, cost, or outcome of freight services.
Shipper terms
If you post freight requests as a shipper, you agree to:
- Provide accurate and complete shipment information.
- Use the Platform for legitimate freight sourcing purposes only.
- Evaluate forwarder quotes and credentials independently before awarding business.
- Not circumvent the Platform to avoid fees owed by forwarders where applicable.
Forwarder terms
If you register as a forwarder, you agree to:
- Provide truthful company information and valid licensing documentation upon request.
- Submit quotes in good faith based on the information provided in freight requests.
- Maintain an active Connected membership where required to respond to in-app freight leads.
- Not misrepresent capabilities, coverage, or pricing.
- Comply with applicable laws governing freight forwarding in all jurisdictions where you operate.
Membership and billing
Connected membership is billed annually at the price displayed on the Platform at the time of purchase. Payments are processed by Stripe.
Membership fees are non-refundable except where required by law. We may change pricing with reasonable notice; existing subscriptions are honored through their current billing period.
Listed (free) directory profiles are subject to approval and may be removed for policy violations or inaccurate information.
User content
You retain ownership of content you submit. By posting content on the Platform, you grant CargoLinked a non-exclusive, worldwide license to use, display, and distribute that content as necessary to operate the Platform.
You must not post content that is unlawful, misleading, infringing, or harmful. We may remove content that violates these Terms.
Prohibited conduct
You may not:
- Use the Platform for unlawful purposes or to transmit malware.
- Scrape, crawl, or harvest data without our written permission.
- Impersonate another person or company.
- Interfere with Platform security or performance.
- Post false freight requests or fraudulent quotes.
Disclaimers
THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CARGOLINKED AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE PLATFORM.
OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR THE PLATFORM SHALL NOT EXCEED THE GREATER OF (A) AMOUNTS YOU PAID TO CARGOLINKED IN THE TWELVE MONTHS BEFORE THE CLAIM, OR (B) USD $100.
Indemnification
You agree to indemnify and hold harmless CargoLinked from claims, damages, and expenses arising from your use of the Platform, your content, or your breach of these Terms.
Termination
You may close your account at any time by contacting support. We may suspend or terminate access for violations of these Terms or for operational reasons with notice where practicable.
Provisions that by their nature should survive termination (including disclaimers, limitation of liability, and indemnification) will survive.
Governing law
These Terms are governed by the laws of the jurisdiction in which CargoLinked is incorporated, without regard to conflict-of-law principles. Disputes shall be resolved in the courts of that jurisdiction, unless otherwise required by mandatory consumer protection laws.
